Overview:
Application for fixation of water rates. Petitioners Village of Scarsdale, Suez Water Westchester, Inc., Westchester Joint Water Works, City of White Plains, City of Yonkers and Town of Greenburgh (Upstate Communities) petition challenging the NYC Water Board’s fixation of water rates for entitlement and excess water for fiscal years 2015-2017. Ruling on the Scope of the Department's Jurisdiction to Review and Fix Water Rates issued 4/26/17. Petitioners requested the opportunity to respond to the ALJ’s December 1, 2023 ruling. The ALJ granted the request, and Petitioners filed a response dated February 29, 2024. In a ruling dated April 17, 2024, the ALJ affirmed the December 1, 2023 ruling and granted the Water Board’s motion to dismiss Petitioners’ proposed issues for adjudication. The Commissioner is considering timely filed appeals and replies from the April 17, 2024 ruling.
In a Decision, Order and Judgment, dated August 2, 2024, from Supreme Court, Albany County, Justice David M. Gandin directed the Department to use a “fair and reasonable” standard in reviewing challenges for excess water rates. Decision of the Acting Deputy Commissioner issued on November 8, 2024.
